This document contains the Copyright policy of the website Phyrtual.org (“Phyrtual” or the “Website”) created at the Fondazione Mondo Digitale (“FMD” or “We”). Phyrtual is an interactive, modifiable, evolutionary website aimed at enriching and empowering people and communities through the pursuit of social innovation based on knowledge, wisdom, arts, positive emotions, community building (social networking) and supporting instrumentation for these activities. In short, it is a virtual innovation environment that integrates with physical innovation environments (Physical & Virtual = Phyrtual) giving rise to Phyrtual movements dedicated to social innovation projects, programmes and initiatives for a better world.
Phyrtual.org aims to stimulate the richest and widest possible contribution, dissemination, circulation, and use of content (i.e., data, information, knowledge, works of art, etc.) that in any form (i.e., text, audio, animations, video, graphics, pictures, paintings, etc.) enhances the chances of success of processes of social innovation that benefit society as a whole, or, disadvantaged sectors of the population. The FMD recognizes that the realm of social innovation contains a large diversity of situations and that a single, universal copyright policy, may not be appropriate for all types of social innovations and for all types of contributions.
Key issues in this respect are (a) the balance between commercial and non-commercial purposes; and (b) the degree to which the copyright license limits or not the use of an item of content contributed by an author or authors. In the first key issue, it must be taken into account that, today, there are organizations in the social sector, such as social enterprises and social firms, that use trading as a way to fund their social projects, always keeping the profit motivation subordinated to the social aims. Other organizations may trade tools or apps that offer important advantages to social innovation projects at a cost that facilitates inclusive affordability and access.
On the second key issue, there are users who may wish to contribute their work to Phyrtual to advance a social innovation, allowing other users to reproduce and circulate it but not to tweak and transform it, for instance, a work of art, or an academic paper. Phyrtual seeks to cater for all these possibilities, by allowing the contributors to select the type of licence they grant to their original content. In all cases, however, the author of the original content must be explicitly acknowledged when it is made use of by others.
Authors of original works or content contributed to Phyrtual can choose among the six alternatives licenses offered by Creative Commons. From the freest to the most restrictive license, in the understanding that when no license is explicitly selected the default licence is the freest of all, i.e., Attribution 3.0 Unported or “by license.” (see first license below).

This license lets others distribute, remix, tweak, and build upon your work, even commercially, as long as they credit you for the original creation.

(5) Attribution-Noncommercial-Share Alike 3.0 Unported (by-nc-sa license)
This license lets others remix, tweak, and build upon your work non-commercially, as long they credit you and license their creations under the identical terms. Others can download and redistribute your work just like the by-nc-nd licence, but they can also translate, make remixes, and produce new stories based on your work. All new work based on yours will carry the same license, so any derivatives will also be non-commercial in nature.

(6) Attribution Non-Commercial No Derivatives 3.0 Unported (by-nc-nd license)
This license is the most restrictive of Creative Commons’ six main licenses, allowing redistribution. This license allows others to download your works and share them with others as long as they mention you and link back to you, but they cannot change them in any way or use them commercially.

License of content to Phyrtual.org
All users providing content to Phyrtual grant the FMD a license to use such content for the purposes of disclosure in the Phyrtual website. This license permits Phyrtual to reproduce, distribute, translate and digitize such content, wholly or partially, for purposes of satisfying the requirements of the services given by the website. The license also permits the FMD to adapt the content for purpose of complying with the technical requirements of the interface, display and performance of the diverse services. This licence of content to the FMD includes the presentation of products and services from social firms, social enterprises, social businesses and any other organization trading these products and services to support social innovations. The same is valid for organizations trading tools or apps that offer important advantages to social innovation projects at a cost facilitating inclusive access.
Proprietary Intellectual Property Right (IPR)
Under no circumstances, Phyrtual users can make unauthorized use (i.e., upload, submit, email/post transmit or make available) of original work of authorship protected by proprietary intellectual property rights (i.e., patents, trademarks, copyrights, or other proprietary rights). This material is normally subject to claims of law infringements and the FMD will remove it once we become aware of its unauthorized use. Phyrtual users can make use of work protected by proprietary intellectual property rights, if they have been legally authorized by the IP owners and only within the limits established by the authorization.
If you believe in good faith and have evidence that your work is being used in ways that infringe the copyright law, please provide Phyrtual.org with the following information:
1) Your name, address, email address, telephone number and (if available), fax number.
2) A digital or physical signature of the copyright owner or a legal agent authorized to act on its behalf.;
3) Precise description of the work whose copyright you believe has been infringed;
4) Precise description of the location where to find the copyrighted work you believe has been infringed, for instance, providing the URL helps to locate content rapidly;
5) A statement confirming that (a) the complaining side believes in good faith that the use of copyrighted material has not been authorized by the copyright owner, a legal agent, or the law; (b) the information given in the notification of copyright infringement is believe in good faith to be accurate and well informed; and (c) the complaining side is the copyright owner or a legal agent authorized to act on its behalf.

Abusive and Inappropriate Content
To report content that you believe in good faith to be abusive, harassing, inappropriate, or violates privacy norms, you must follow the same procedure as with infringement of copyrighted material, sending to us your complaint.
